Generally, if you are entitle to make an application,
you have a
right
to start your your application process under the
relevant "Immigration Rule".
However, your application success will depend on
two major grounds
as follows:-
-
WITNESS STATEMENTS:-
(This
is usually any information supplied on your
application form)
-
DOCUMENTARY EVIDENCE:-
(This
is any
third party or
an
independent document in your
possession which support your witness statement
supplied on your application form. The documents
required of you are case specific; therefore, you
should always check with your legal adviser for help
and advice.
PRACTICAL POINT OF VIEW:-
Higher numbers of application made to ECO and UKBA were
being refused because of lack of relevant documentary evidence
which corroborate the applicant's claim. Always get
advice from a qualified immigration adviser which is
authorised to provide immigration advice and
services.
-
NOTE:-
That
you may be able to receive free legal advice and
services from your Law Centre or Citizen Advice
Bureau,
-
that,
UKBA /Home Office Customer Service do not provide
legal advice. However, they may be able to give you
guidance.
-
that,
it is better to get things right in the first
instance. An appeal will cost you more than normal
application.
